Terms of service

Any order for a product appearing on the www.unno.co.za online store requires prior consultation of these terms.

Consequently, the consumer fully accepts that their agreement on the content of these conditions does not require the signature of this document, insofar as the customer wishes to order the products presented online in the framework of the website. The consumer has the option to save or print these general conditions, with the saving and printing of this document being the sole responsibility of the consumer.

The www.unno.co.za merchant site is the sole property of Apex Sport (PTY) LTD. The consumer declares that they have full legal capacity to accept the present general terms & conditions of sale. Apex Sport (PTY) LTD reserves the right to modify the present general terms & conditions of sale.


1 - Integrality

The present terms represent all obligations of the parties. This contract is concluded between a consumer and Apex Sport (PTY) LTD in the case of a system of selling goods at a distance.

In this sense, the consumer is deemed to accept without reservation all the provisions of these terms. No general or specific condition appearing in documents sent or given by the consumer may be incorporated herein, since these documents are inconsistent with these terms.


2 - Object

The present general conditions are intended to define the rights and obligations of the parties as part of the online sale of goods offered by Apex Sport (PTY) LTD to consumers.

The consumer declares, prior to their order, that the acquisition of these products is not directly related to their professional activity, their acquisition being reserved for personal use.

As a consumer, the customer has specific rights, which would be jeopardised in the event that the goods or services purchased through the website were in reality related to their professional activity.


3 - Validity and duration

These conditions come into force on the date of confirmation of the order. These general conditions are concluded for the time necessary for the provision of goods purchased, until the expiry of the guarantees legally owed by the seller.


4 - Order confirmation

All contractual information will be confirmed via e-mail no later than the time of delivery or failing that, to the address specified by the consumer in the purchase order.


5 - Proof of transaction

The records stored in Apex Sport (PTY) LTD's computer systems under conditions of reasonable safety, will be considered proof of communication, orders and payments between the two parties. The filing of purchase orders and invoices is done on a reliable and durable media which can be produced as evidence.

Apex Sport (PTY) LTD can in no way be held liable for any loss of data following an incident in which they are not responsible.


 

6 - Pricing

All pricing is in ZAR. Pricing does not include transport costs which are added to the final invoice, and are indicated before final confirmation of the order. Pricing takes into account the VAT applicable on the day of the order. Payment of the totality of the order must be completed during the order process. At no point can any amount submitted be considered as a deposit.

In the case of an export sale, all applicable taxes in the buyers country remain the responsibility of the buyer.

Apex Sport (PTY) LTD reserves the right to modify pricing at their discretion. Any pricing modifications will be signaled to the buyer before any order throughout the year depending on exchange rates and the increase in price of raw materials.


7 - Purchase and delivery

Once the payment is received, Apex Sport (PTY) LTD will have 15 calendar days to deliver the merchandise to the carrier. The reception, by the CLIENT, will depend on the delivery address and the conditions of the carrier

We inform our clients that prior administrative authorization is not necessary for the sale of the products.

Once you provide your information and the contract is perfected, an archival electronic document will be generated to which you have the right of access.

7.1 - Delivery procedure

Products are delivered throughout South Africa to the address indicated by the consumer on the order form.

Any delivery anomaly (missing parcel, missing product as listed on the order form, damaged parcel, broken products, etc) should be indicated on the delivery form accompanied by the customers signature.

The consumer will need to confirm this anomaly by addressing the reclamations in a letter to the delivery company within two (2) days via recorded delivery letter with counter-signature.

The consumer will need to transmit a copy of the annotated delivery note via mail to Apex Sport (PTY) LTD.

The consumer is responsible for verifying the condition of the parcel(s) and the number of parcels delivered in the presence of the delivery driver. In case of doubt, the consumer should refuse the delivery and inform Apex Sport (PTY) LTD.

All our expeditions are covered by insurance corresponding to the value of the parcel and is taken care of by our company.

7.2 - Delivery costs

The shipping costs will be indicated, and added to the total on each order as done by the buyer.


8 - Withdrawal and returns

The CLIENT has 14 calendar days to terminate this contract without needing any justification. The term of 14 days will begin to count from the moment in which the CLIENT acquires the material possession of the product.

To exercise the right of withdrawal, the CLIENT must notify Apex Sport (PTY) LTD ​​of his decision to cancel the contract, by email to: customerservice@apexsport.co.za and return the merchandise to the address of UNNO ​​indicated on the invoice. You can also use the model withdrawal form, which you will receive along with the product, although its use is not mandatory.

In case of withdrawal, Apex Sport (PTY) LTD ​​will return the payments received, excluding the cost of return of the product, without undue delay and once it has received and verified that the product meets the conditions of withdrawal.

The CLIENT will only be responsible for the decrease in the value of the box, resulting from a manipulation different from what would be necessary to establish the nature, characteristics and proper functioning.

Apex Sport (PTY) LTD will proceed to make such refund by bank transfer to the account indicated by the CLIENT and in no case, the CLIENT will incur any expense, as a result of the refund, except for the total cost of the return.

 

9 - Warranty

UNNO offers a warranty period, for the manufacturing defect of its frames, of 5 years, and for the painting of its 2 year, counted from the date of payment. This warranty will only be valid for the original purchaser of the product, who must provide a copy of the purchase invoice.

This warranty is fully compatible with the warranties offered by the distributors of the components that we assemble on our bicycles.

The CLIENT assumes the shipping costs, reserving to Apex Sport (PTY) LTD ​​his right to request the shipment of the product for his evaluation and the opinion of an expert.

Apex Sport (PTY) LTD reserves the right to repair or replace the product claimed, and its final decision is binding. In case of total replacement of the claimed product, Apex Sport (PTY) LTD ​​guarantees that the product will be replaced by one with the same characteristics. The colour and model of the replacement product will be chosen according to the available stock.

9.1 - Conditions of warranty

The user must keep the product purchased in good condition in accordance with the instructions and recommendations specified in the bicycle manual, and may be rejected by Apex Sport (PTY) LTD ​​warranty claims that directly respond to a defect in product maintenance by the user .

The warranty does not apply in any case to breakages or defects resulting from the negligent use of the bicycle, the assembly of other non-original accessory elements to those supplied or assembled by Apex Sport (PTY) LTD, or inadequate handling and maintenance operations by the user, or by any third party on his behalf.

This warranty does not cover in any case the usual wear of the perishable elements of the product.

Due to the danger inherent in the use of a bicycle, both on the road and in the mountains, and the physical risks derived from its use, this warranty refers only to the replacement of the non-conforming components, and does not cover the damages in any case personal injuries that may arise directly or indirectly from the failure of the same during use. In the event of a circulatory accident, regardless of the direct cause thereof, the Apex Sport (PTY) LTD ​​warranty is completely canceled.

This warranty will be subject to the decision of our technicians, about the nature of the lack of conformity of the product, after a study of the piece in question.

 

10 - Accident policy

Apex Sport (PTY) LTD offers an accident policy in case of cracking or breakage of the frame or bicycle due to external factors not related to manufacturing defects. This policy is based on the application of a discount on the acquisition of a new frame or bicycle as the case may be. For more information, contact customerservice@apexsport.co.za.

 

11 - Partial non confirmation

If one or more provisions of these terms are held to be invalid or declared as such under any law, regulation or after a final decision of a competent jurisdiction, the remaining provisions will remain in full force and scope.


12 - Non-waiver

The failure of either party not to claim a breach by the other party to any of the obligations under these Terms shall be construed in the future as a waiver of the requirement involved.


13 - Applicable laws

The present general terms & conditions are under the jurisdiction of South Africa law. In the event of a reclamation or a litige, the consumer should first and foremost contact Apex Sport (PTY) LTD so as to find an amicable solution.
